Yes, background checks are permitted in Brazil, but there are regulations governing their use. The Brazilian Constitution guarantees privacy rights, so background checks must comply with laws protecting individuals' privacy and personal data. Employers, for instance, may conduct background checks on potential employees, but they must adhere to strict guidelines outlined in the Brazilian Labor Code and other relevant legislation. These guidelines typically include obtaining consent from the individual being checked and ensuring that the information gathered is relevant to the job position.
A national search for criminal and civil records is carried out through the Ministry of Justice, the Court of Justice of each State and the Federal Court of Justice. Results typically include criminal convictions within the last 7 years that were not expunged or pardoned.
The main information used to carry out the search is the CPF (Cadastro de Pessoa Física / Individual Taxpayer Registration) number – an 11-digit personal document.
The most common types of background checks in Brazil include criminal history, employment history, and educational background checks. However, this largely depends on the position and the hiring company's policies. Therefore, it may also encompass financial history, driving history (for drivers and couriers), professional license, and others.
